Then if the can trace back the warranty issue to the tune then you likely won't be covered.

This is a fuel vent (aka tank ventilation) issue which is an inherent issue for the models under the build dates and basically an internal "recall". Granted that I'm ignorant to the world of mods (the M850i is the first car I've owned in which I'd consider any) but I do not see how the voided warranty on sollomon M8 for modified "cold air intake, exhaust and suspension" would exclude BMW's responsibilities to repair the take ventilation issue if his M8 falls under the bulletin.

I suppose there might be some pre-production M8s built in 2018 that weren't scrapped? So nothing a consumer might actually be driving around, but still something the recall should cover.
