Pedestrian impact legislation has impacted this as it is too low.

The Hoffmeister kink is a staple of BMW design as are many elements of design, icons if you will that are being interpreted by other manufacturers. Walking around the Geneva Auto Show there were many models that "interpreted" these icons.
Double Halo headlights,L shaped rearlights, air breathers and many more but yes the Hoffmeister kink is another element.

Infiniti is a good example. With many BMW elements drawn over with a compass. The new design direction for BMW is more cleaner and crisper. In The 8. This is clear as is the forthcoming models all utilise these more original design elements to BMW at least.
