I have been informed that as the summer heat is coming, this issue is starting to show up in other parts of the country, we'll see how it develops.

Wow, I would have thought BMW would have insisted the dealership thoroughly test the ac before delivering the replacement to you, or why go through all the trouble? Hope this all gets sorted out and a solution is found. When you test drove yours or others were they working ok?
